1. The Defendant indicated in Appendix 1, 2, 7,287, among the 7,287 square meters of land B in Nam-gun, Naman-gun, the Defendant, as shown in Appendix 1, 2, 3, 4, 5, 6, 7, 9, 9,
Reasons
1. Facts of recognition;
A. On June 1, 1939, G forest land category D and E land change (1) G was registered with the land registered in the registration conversion register and the forestry map with the land cadastre and the cadastral map as of June 1, 1939 (hereinafter “D land before subdivision”). As to the land B before the said subdivision, each registration transfer under J’s name was completed in sequence on January 8, 1981, H, June 16, 2005, I, June 20, 2005, and June 20, 2005.
(2) On September 25, 2017, the Plaintiff (Appointed Party; hereinafter “Plaintiff”) and the Appointed entered into a sales contract on D land with J on September 25, 2017. The Selection C purchased the 1,725 square meters of shares (63.5 square meters of shares) and the 992 square meters of shares (36.5 square meters of shares) and then divided according to the above shares.
(3) Accordingly, on September 28, 2017, the Plaintiff and the Selected C completed a joint registration in accordance with the above equity ratio with respect to D land before subdivision. However, the Plaintiff divided D land before subdivision into D’s 1,725 square meters (hereinafter “D land”) and E before E, 92 square meters (hereinafter “E land”). As to D land, the Selected on February 28, 2018 completed the separate registration in its name with respect to E land.
B. The alteration relation to the land of this case (1) The defendant is adjacent to the D land prior to the partition (G forest before the registration conversion)
2. On 14. K forest land, the registration of ownership transfer is completed with respect to 10,512 square meters (hereinafter “K forest”).
(2) While the Young River Management Office in the Korea Forest Service under the Defendant’s jurisdiction manages the area equivalent to 2,634 square meters of K forest land as an unauthorized occupation, the said area without permission was approved as being able to change land category and lease subsequent thereto pursuant to Article 2 of the Addenda of the former State Forest Management and Management Act (amended by Act No. 13383, Jun. 22, 2015). On July 12, 2017, the Korea Land Information Corporation requested the Korea Land Information Corporation to conduct a subdivision survey and registration conversion of the above portion of K forest land without permission.
