A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
The Defendant, “E” in the Jung-gu Incheon Metropolitan Government D and 1st floor, was actually operating the “E” lawsuit, and was entrusted by BD to manage the BE building 702 in the Incheon Jung-gu as monthly income. However, the Defendant was willing to enter into a lease contract by deceiving the lessee and receive the deposit money for the lease contract as if he was delegated by BD to use the money for the repayment of personal debt.
1. On February 27, 2014, the Defendant forged a private document with the name of BD in the column of the office of Jung-gu Incheon, the Jung-gu Office of BF, 112, to the effect that the lessee was entrusted with the conclusion of the lease contract by BD from the owner of the above BE building 702, and the lessee was located in the column of the office of BD in the space where “Y-gu Incheon Metropolitan City, Jung-gu BE building 702,” “Won 40,000 won (Won 40,000,00)” in the deposit column, “Won 2,00,000 won (Won 2,00,000),” and the name of BD after entering “BD” in the column of BD, the lessor column, “BD” and “BH”.
Accordingly, for the purpose of exercising authority, the Defendant, without authority, forged the Chapter 1 of the Officetel charter contract in the name of BD, a private document related to rights and obligations.
2. At the same time and place as in the preceding paragraph, the Defendant: (a) delivered to the above BH one of the forged pre-sale contract, which was aware of the forgery, as if it were the document duly formed; and (b) exercised the aforementioned investigation document.
3. The Defendant, at the same time and time as set forth in the preceding paragraph, issued a copy of the former lease contract, which was forged to the victim BH, and was committed as if he/she had legitimate authority upon delegation by the lessor for the conclusion of the lease contract.
The defendant deceivings the victim as above and is in the same position as the deposit money for the same day from the victim.
