2. The judgment of the court below is contrary to the defendant, and the defendant did not have any past conviction in excess of the same kind or fine because of favorable circumstances. However, the fact that there was no assault by direct physical contact, but there was a high risk of danger as many police officers, considering the motive and circumstance of the crime, the degree of damage, the character and conduct of the defendant, and the environment, the punishment imposed by the court below cannot be deemed to be too heavy or unreasonable.

3. In conclusion, the appeal filed by the defendant and the prosecutor is without merit, and all of them are dismissed in accordance with Article 364(4) of the Criminal Procedure Act. It is so decided as per Disposition.
