Defendant

A shall be punished by imprisonment with prison labor for a year and six months, and by imprisonment with prison labor for a year.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

1. Defendant A

(a) The maximum interest rate under a contract for lending and borrowing of money in violation of the Interest Limitation Act shall not exceed 30 per annum;

The Defendant, around April 25, 2012, lent KRW 50 million to the Victim E and required to refund KRW 700,000 each day to KRW 90,000 each day, and received KRW 2 million as of the same day on July 24, 2012, and entered into a monetary lending agreement equivalent to KRW 193% of the annual interest rate by receiving a total of KRW 63,70,000 from 56 times until July 24, 2012, and received interest corresponding thereto.

In addition, the Defendant received interest exceeding 30% per annum, such as lending a total of KRW 442 million to the victim and receiving a total of KRW 2587 million, on seven occasions until May 14, 2014, as shown in Appendix I.

(b) Any debt collector who violates the Fair Collection of Claims Act shall not assault, threaten, arrest or detain a debtor or his/her related person in connection with debt collection, or use a deceptive scheme or force against him/her, and shall not engage in any act which seriously undermines his/her privacy or peace in his/her business by repeatedly or at night reaching the debtor or his/her related person by sending words, letters, sound, image, or things by telephone, etc. without justifiable grounds, and by causing fear or apprehension;
