1. The Defendants are to the Plaintiff:

(a) Attached drawings and specifications (1), (2), (3), (4), and (1) of the real estate listed in the Attached List;

Reasons

1. Facts of recognition (applicable for recognition: The fact that there exists no defendant A-Cine dispute, each entry in the evidence of subparagraphs 1 through 5, the purport of all pleadings, and the conclusion of the whole pleadings, Defendant B-B-B-B);

가. 원고는 별지 목록 기재 부동산의 소유자인 성동구로부터 별지 목록 기재 부동산을 포함한 서울특별시 성동구청 체육시설에 대한 관리를 위탁받은 관리자로서, 2011. 3. 14.경 피고 A과 사이에 별지 목록 기재 부동산 중 별지 도면표시 ①, ②, ③, ④, ①의 각 점을 순차로 연결한 선내 ㈎부분 12.5㎡(이하 ‘이 사건 점포’라고 한다)에 관하여 임대차기간을 1년, 시설명 C으로 정하여 임대차계약을 체결하였다.

B. After that, the Plaintiff renewed the said lease agreement with the Defendant on a one-year basis, and the terms and conditions of the renewed contract concluded on March 31, 2013 are as follows.

(hereinafter “instant lease agreement” (hereinafter referred to as “instant lease agreement”): From April 1, 2013 to March 31, 2014 (1 year, 3rd year extension contract): Rent of 4.360,000 won (excluding value-added tax) per annum; and rent of 4.360,000 won (excluding value-added tax) shall not be refunded on a yearly basis (Article 3); however, the same shall not apply where permission for use is terminated because it is necessary for the important public services of “A (referring to the Plaintiff; hereinafter the same shall apply)” or it is difficult to continue to lease or manage due to a natural disaster, etc. (Articles 4 and 13) (4); hereinafter the same shall apply) “B (referring to Defendant A; hereinafter the same shall apply)” shall enter into a fire insurance contract with “A” and the insurance premium shall be borne by “B” and the certificate thereof shall be submitted to “A”.

(Article 5) 5. 5 “B” may not arbitrarily alter the leased property without the consent of the “A”, and shall be responsible for the preservation of the leased property with the care of a good manager, and the remuneration necessary for the use of the facilities shall be borne by the “B”, and the expenses required therefor may be claimed by the “A”.
