Punishment of the crime
[Attachment to repeated crime] On November 17, 2016, the Defendant was sentenced to one year of imprisonment for fraud, etc. at the Busan District Court, and completed the execution of the sentence on September 10, 2017.
[2019 Highest 569] On November 21, 2018, the Defendant issued orders to the Victim C within the D main points operated by the Victim C, located in Busan East-gu, Busan, to the Victim C, but there was no money to pay the amount in fact. [2019 Highest 1229] On March 6, 2019, the Defendant: (a) visited the victim F of the victim F in the Busan East-gu, Busan East-gu with two drinking places; and (b) did not have any money to pay the victim for alcohol, entertainment, etc.; (c) therefore, the Defendant did not have any intent or ability to pay the price even if he was provided with alcohol, alcohol, and entertainment by the victim.
Nevertheless, the Defendant, by deceiving the victim, provided the victim with KRW 260,000 in total and KRW 300,000 in total and KRW 560,00 in total and KRW 300,00 in entertainment expenses, and acquired pecuniary profits equivalent to the same amount.
[2019 Highest 1852] On March 29, 2019, the Defendant, at around 22:30 on March 29, 2019, placed an order for alcohol to the victim as if he would normally pay the drinking value.
However, the defendant did not have an intention or ability to pay the drinking value because he did not possess cash or credit card.
The Defendant, by deceiving the victim as such, was provided by the victim with an amount equivalent to KRW 350,00,000 at the market price of 1 disease in his/her sirens.
