A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On November 22, 2013, the Defendant was issued a summary order of KRW 1,50,000,000 by a fine for a violation of the Road Traffic Act due to a violation of the Road Traffic Act, etc. at the Jeonju District Court’s Full Eup branch on November 22, 2013, and on March 7, 2016 by the same court on March 7, 201, respectively.

피고인은 2016. 10. 31. 11:30 경 정읍시 입암면 67-9에 있는 ‘ 그린 피드’ 앞 도로에서부터 정읍시 입암면 서문회관 앞 도로에 이르기까지 약 7km 구간에서 원동기장치 자전거 면허를 받지 아니하고 번호판 없는 효성 프리마 랠리 오토바이를 운전하고, 계속하여 같은 날 12:17 경 정읍시 입암면에 있는 서문회관 앞 도로에서부터 정읍시 입암면 하부리 2374 앞 도로에 이르기까지 약 2km 구간에서 원동기장치 자전거 면허를 받지 아니하고 혈 중 알코올 농도 0.098% 의 술에 취한 상태로 위 오토바이를 운전하였다.

2. The Defendant violated the Guarantee of Automobile Damage Compensation Act: (a) operated the foregoing urbine, which was not covered by mandatory insurance, at the same time and place as paragraph (1).

1. Punishment provided for in Articles 40 and 50 of the Criminal Act for the crimes of violation of the Road Traffic Act and the crimes of violation of the Road Traffic Act, which are more severe punishment among the crimes of violation of the said Act and the crimes of violation of the said Acts;

1. Selection of imprisonment with prison labor chosen;

1. The former part of Article 37 of the Criminal Act, Article 38(1)2 of the Criminal Act, and Article 50 of the Act on the Aggravation of Concurrent Crimes.
