1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. Entertainment Co., Ltd. (hereinafter “ Entertainment”) is a multi-level selling company engaged in food, agricultural and fishery products, and wholesale and retail distribution business in accordance with the Act on Door-to-Door Sales, Etc., and the Plaintiffs signed a contract to purchase goods by joining a multi-level selling organization of entertainment in around 2013, and the Plaintiffs paid KRW 61,736,70 to Plaintiff A as the price for goods, Plaintiff B as the price for goods, and Plaintiff C as KRW 65,038,30.
B. After that, Plaintiff A received an order to pay the refund amount of KRW 61,736,70 on March 17, 2014 with the claim amounting to KRW 61,736,700 from a member of an entertainment association or terminated a contract to purchase goods, and thereafter, the said order for payment became final and conclusive around that time. Plaintiff B and C filed a lawsuit for claiming the refund amount of KRW 41,060,762, KRW 65,038,300 with the court 2014hap204, as the court 20450, respectively, and the judgment became final and conclusive around that time.
C. Meanwhile, entertainment held a claim for the return of investment to the said union in accordance with the mutual aid transaction agreement with the Korea Special Sales Mutual Aid Association. On May 2014, the said union deposited KRW 3,884,45,632 of the relevant claim amount under this Court’s No. 10034 under Article 248(1) of the Civil Execution Act, on the ground that creditors of entertainment, including the Plaintiffs, issued a provisional attachment, seizure, and collection order, etc. on the said claim for the return of investment amount.
Accordingly, the distribution procedure of this Court D (hereinafter “instant distribution procedure”) was commenced on October 31, 2014, and the above court held that the wage creditors E (appointed parties) who received a seizure and collection order under the court 2014TT order under the court 2014TT order under the court 2014TT order under the court 102,184,239,239, and 2nd order under the court 2014TT order under the court 15,51,245 won and 3nd order to the wage creditors F (appointed parties) who received a seizure and collection order under the court 2014TT order under the court 2014TT order under the court 20296, the remaining 3,892,114,412 won, each.
