In cases where a registration has been made on a destroyed building or non-existent building, whether the owner of the site has a benefit to seek the implementation of the registration of ownership transfer or the procedure for cancellation of registration of ownership preservation against the registrant of the building (negative)
Summary of Judgment
In the event a building is destroyed or lost, the owner of the site of the building applies for the registration of destruction by subrogation of the right holder registered on the register of the building pursuant to Article 101(1) and (4) of the Registration of Real Estate Act. In the event that a registration of destruction is made on a non-existent building, the owner of the site of the building can file an application for the registration of destruction by the above method pursuant to Articles 101-2(1) and (2), and 101(4) of the same Act. If the registration of destruction is made in accordance with the above procedure, the registration of destruction or loss may be completed even without the co-application or consent of the owner of the building. If the registration of destruction is made in accordance with the above procedure, the registration of ownership transfer and registration of preservation of ownership recorded on the register will lose its effect. Text
1. Of the instant lawsuit against the Plaintiff, the claim for cancellation of the registration of ownership transfer as to the building listed in [Attachment 2 and 3] of [Attachment 1] and the claim for cancellation of registration of ownership transfer as to the building listed in [Attachment 1] shall be dismissed, respectively.
2. Defendant Assistant Director shall:

Reasons
Determination as to the legitimacy of the lawsuit against the Vice Minister of Justice of the Republic of Korea
The plaintiffs seek implementation of the procedure for registration of cancellation on the ground that the above building has been destroyed or lost, with respect to the registration of each transfer of ownership as stated in the claim for the registration of each transfer of ownership as to the building listed in the separate sheet Nos. 2 and 3 of the separate sheet No. 1. Meanwhile, the plaintiffs seek implementation of the procedure for registration of cancellation on the ground that the registration of cancellation on the ground that the registration of preservation of ownership as stated in the claim for registration of cancellation on the building listed in the separate sheet No. 1
2. According to Articles 101-2(1), 101(2) and 101(4) of the Registration of Real Estate Act, the owner of a building site may file an application for the registration of destruction of a building in lieu of the right holder registered on the register of the building in lieu of the owner registered on the register of the building where the building was destroyed or lost. If a building site is registered on non-existent, the owner of the building site may file an application for the registration of destruction of the building in the above manner without the joint application or consent of the owner of the building. Judgment on the merits
Basic Facts
The following facts are established without any dispute between the plaintiffs and the vice-chief of defendant, the principal house, and the abnormal crime, or between Gap evidence 2-1 through 10, Gap evidence 3-1 through 3, Gap evidence 4-1 through 4, Gap evidence 4-4, Gap evidence 6-1 through 4, Gap evidence 6-13, Gap evidence 6-1 through 26, Gap evidence 7-1 and 7-2, the testimony of Kim Young-young, the result of this court's on-site inspection and the result of the survey and appraisal by Kim Jong-won, and there is no other counter-proof, and it is deemed that the above defendants were led to confession pursuant to Article 139 (1) and (3) of the Civil Procedure Act.

이 사건 ㉲ 내지 ㉻ 부분 각 건물은 별지 2 목록 제3항 기재 건물에 관한 일반 건축물 대장(갑 제3호증의 1) 및 등기부 등본(갑 제2호증의 3)에 등재되어 있다.

위 인정 사실에 의하면, 별지 2 목록 제2항 기재 토지 및 이 사건 ㉲ 내지 ㉻ 부분 건물을 직접 또는 간접점유하는 피고 조차장은 위 각 부동산의 공동소유자인 원고들에게 같은 목록 제2항 기재 토지를 인도하고 위 이 사건 ㉲ 내지 ㉻ 부분 건물을 각 명도할 의무가 있다.

The argument of the cause of claim
The plaintiffs, based on the above facts, are direct or indirect possessors of the land listed in Section 1 of the Attached Table 2 List, and Defendant Cho Jong-soo, the co-owner of the land listed in Section 1 of the same Table, who is the co-owner of the land listed in Section 1 of the same Table, asserts that the plaintiffs have a duty to deliver the land listed in Section 1 of the same Table to the plaintiffs, who are co-owner of the land listed in Section 1 of the same Table (the plaintiff's claim for the surrender of the building in this case or the section of the building in this case,

Therefore, the defendant Cho-soo, who acquired legal superficies on the lower or lower part of the building site of this case, has a legitimate right to possess that part of the land. Therefore, the defendant Cho-soo is obligated to deliver only the remaining part of the land except the above building site among the land listed in attached Table 2 List 1 to the plaintiffs.
Determination as to the claim against the defendant's accommodation or abnormal crime
The argument of the cause of claim
The plaintiffs, based on the above facts of recognition, asserts that the defendant be aware of the defendant who occupies the scam part of the building of this case, and the defendant be aware of the fact that the defendant who occupies the walle part of the building of this case and the walp part of the building of this case, and the defendant's abnormal crime that occupies the walp part of the building of this case is obligated
Judgment on the defenses of the defendant bed and older than the defendant

Determination on the claim against Defendant Lee Jin-hee and Kim Sung-sung

3. Conclusion
그렇다면 피고 조차장은 원고들에게 별지 2 목록 제1항 기재 토지 중 이 사건 ㉮ 내지 ㉱ 부분 토지를 제외한 나머지 토지 및 같은 목록 제2항 기재 토지를 각 인도할 의무가 있고, 같은 목록 제 1, 2항 기재 토지 지상의 이 사건 ㉲ 내지 ㉻ 부분 건물을 각 명도할 의무가 있으며, 피고 이승희는 원고들에 대하여 같은 목록 제2항 기재 토지 지상의 이 사건 ㉷, ㉸ 부분 건물에서 퇴거할 의무가 있고, 피고 김성균은 원고들에 대하여 같은 목록 제1, 2항 기재 토지 지상의 이 사건 ㉳, ㉴ 부분 건물에서 퇴거할 의무가 있다. 그러므로 원고들의 이 사건 청구 중 피고 조차장에 대한 청구는 위 인정 범위 내에서 이유 있어 이를 각 인용하고, 피고 조차장에 대한 각 말소등기청구의 소는 부적법하여 이를 각 각하하며, 피고 조차장에 대한 나머지 청구는 이유 없어 이를 기각하기로 하고, 피고 이승희, 김성균에 대한 청구는 이유 있어 이를 각 인용하며, 피고 주유숙, 이상범에 대한 청구는 이유 없어 이를 각 기각하기로 하고, 소송비용은 주문 제6항에 기재한 바와 같이 원고들, 피고들의 각 부담으로 하며, 주문 제2, 3, 4항에 대하여 가집행선고를 붙여 주문과 같이 판결한다.
