2. 2019. 5. 3.자 범행 피고인은 2019. 5. 3. 03:10경 경산시 D에 있는 자신의 사무실에서 위 1.항과 같이 ‘C’ 메신저로 피해자와 대화를 하던 중 피해자에게 “16센티가 작데 ㅋㅋ”, “에구 ”, “경험이 적은가보네”, “서양야동이나 보셈”, “할말없네”, “재수없어!!! 시발!!!”, “박아주면 워매워매 거릴게”, “볼품없데.. 하”, “머하냐고”, “내자지 필요한거아니고 ”, “젖었네”, “솔직히말해”, “부끄러워할거뭐있나”라는 등의 메시지를 보내며 남성의 성기 사진을 3회 이상 전송하였다.
