A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media) shall have the other party reach the other party any words, sounds, letters, pictures, images, or objects that may cause a sense of sexual shame or aversion by telephone, mail, computer or other communications media, with intent to arouse or satisfy his/her or the other party's sexual desire;

Nevertheless, the Defendant:

가. 피해자 C에 대한 범행 (1) 2014. 1. 22. 22:42 경 제주시 D 주변에서 피고인 명의의 이동전화번호 'E' 을 이용하여 피해자 C( 여, 48세) 가 사용하는 이동전화번호 'F '으로 전화를 걸어 피해자가 전화를 받자 1분 10초 동안 피해자에게 “ 음! 으 음! 윽 !”, “ 아 ! 아 ! 아 !” 라고 자위행위를 할 때 나오는 음란한 신음소리를 반복적으로 내 피해자에게 도달하게 하였고, (2) 피고인은 2014. 1. 30. 09:30 경 서귀포시 G 주변에서 피고인 명의의 이동전화번호 'E' 을 이용하여 피해자가 사용하는 이동전화번호 'F '으로 전화를 걸어 피해자가 전화를 받자 1분 8초 동안 피해자에게 “ 으 음! 으 음! 윽 !”, “ 아 ! 아 ! 아 ! ”라고 자위행위를 할 때 나오는 음란한 신음소리를 반복적으로 내 피해자에게 도달하게 하였고,

나. 피해자 H에 대한 범행 (1) 피고인은 2014. 2. 1. 05:20 경 서귀포시 G 주변에서 피고인 명의의 이동전화번호 'E' 을 이용하여 피해자 H( 여, 35세) 가 사용하는 이동전화번호 'I '으로 전화를 걸어 피해자가 전화를 받자 1분 05초 동안 피해자에게 “ 으 음 으 윽 ! ”라고 자위행위를 할 때 나오는 음란한 신음소리를 반복적으로 내 피해자에게 도달하게 하였고, (2) 피고인은 2014. 3. 1. 04:03 경 제주시 J 주변에서 피고인 명의의 이동전화번호 'E' 을 이용하여 피해자 H가 사용하는 이동전화번호 'I '으로 전화를 걸어 피해자가...
