1. The Defendants shall jointly and severally pay to the Plaintiff KRW 124,00,000 and the interest rate thereon from January 19, 2017 to the date of full payment.

According to Gap evidence Nos. 1 and 2-1 and 2-2, each of the facts that the defendants acquired a total of 127,200,000 won from the plaintiff from Jan. 2007 to Apr. 26, 2007 are notified of a summary order of 2008 Go-Ga16486, which became final and conclusive as it is. On Oct. 22, 2007, when the defendants were investigating the above criminal case, they agreed to pay the plaintiff a total of 129,00,000 won by three installments from Oct. 22, 2007 to Dec. 31, 2007, and that the plaintiff received a total of 129,000,000 won from the above contract amount, and the plaintiff is a person who received reimbursement of 5,00,000 won from the above contract amount.

Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff the remainder 124,000,000 won and damages for delay at the rate of 15% per annum from January 19, 2017 to the date of full payment, which is obvious from the date of final delivery of the copy of the instant complaint, as the Plaintiff seeks. Thus, the Plaintiff’s claim of this case seeking such payment is justified, and is so decided as per Disposition.
