A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

No public duty personnel shall leave their service or fail to serve in the field concerned for at least eight days in total without justifiable grounds.

Nevertheless, on December 19, 201, the Defendant, who was placed in C Hospital located in Busan High-gu B, and was engaged in patient relief duties, left from his/her service without justifiable grounds on October 9, 201 to October 10 of the same month, from February 26, 2013 to February 27 of the same month, from March 21, 2013 to March 22 of the same month, from March 21, 201, and January 21, 2014.

As a result, the defendant left his service for at least eight days in total without justifiable grounds.
