1. 피고인은 2013. 6.경 목포시 B에 있는 ‘C’ 피시방에서 컴퓨터를 이용하여 인터넷 사이트 애플파일(http://www.applefile.com)에 아이디 'D', 닉네임 ‘E’로 접속한 다음 위 사이트에 “NOMO 보기만 해도 존슨이 불끈불끈 최고 모음!! 핫 스페셜!”이라는 제목으로 남녀가 옷을 벗고 성기가 노출된 채로 성행위를 하는 음란물인 동영상 파일을 업로드한 것을 비롯하여 별지 범죄일람표 기재와 같이 2013. 6.경 총 5개의 음란물인 동영상 파일을 업로드 한 후 불특정 다수의 위 사이트 가입자들이 다운로드 받아볼 수 있도록 게시하여 정보통신망을 통해 음란물인 위 동영상 파일을 유포하였다.

가. 피고인은 2013. 6. 9.경 목포시에 있는 상호를 알 수 없는 피시방에서 인터넷 사이트 슈퍼다운(http://www.superdown.co.kr)에 아이디 ‘F’, 닉네임 ‘G’로 접속하여, “No 거리에서 헌팅으로 데리구 노래방으로!!(헌팅녀/미친몸매.avi, 찰지네.avi)”라는 음란 동영상 파일을 업로드 하여 불특정 다수의 회원들이 내려 받을 수 있도록 공유시키는 등 정보통신망을 이용하여 음란한 영상을 공공연하게 전시하였다.
