피고인은 2013. 12. 11.경 목포시 B에 있는 피고인의 집에서 컴퓨터를 이용하여 인터넷 사이트 C에 아이디 ‘D', 닉네임 ’E‘으로 접속한 다음 위 사이트에 'New - 성깔녀 - 스샷만큼 생긴여자'라는 제목으로 남녀가 옷을 벗고 성기가 노출된 채로 성행위를 하는 음란물인 동영상 파일을 업로드하여 불특정 다수의 위 사이트 가입자들이 위 동영상 파일을 다운로드 받아볼 수 있도록 게시하여 정보통신망을 통해 음란물인 위 동영상 파일을 유포하였다.
