A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On August 11, 2011, the Defendant was notified of a summary order of KRW 1 million by larceny at the Seoul Central District Court. On July 13, 2012, the Defendant was sentenced to the suspension of the execution of imprisonment with prison labor for six months by night-time building intrusion and larceny. On June 14, 2013, the Seoul East East District Court notified the summary order of KRW 2 million by larceny. On March 8, 2013, the Defendant was sentenced to imprisonment with prison labor for special larceny, etc. at the Daejeon District Court, and completed the execution of the sentence on February 2, 2015.

1. Habitual theft;

A. At around 04:00 on July 5, 2015, the Defendant: (a) committed a theft of the cash amounting to KRW 158,000,00 in the possession of the victim E, which was kept in the victim E, by means of a cresh or inside the bank; (b) KRW 150,000 in cash in the possession of the victim F; (c) KRW 30,00 in cash in the possession of the victim F; and (d) KRW 10,00 in cash in the possession of the victim G posted on the wall; and (d) KRW 348,00 in the market value.

B. The Defendant, like in the case of the preceding paragraph, committed a theft by driving Jone Star Co., Ltd with the victim’s market price at the same time and at the H parking lot of Gangwon-do, which is located in the victim I, using a crepan, at the victim’s market price of KRW 6,400,000.

Accordingly, the defendant habitually stolen the victims' property two times.

2. From July 6, 2015 to July 20, 2015, the Defendant violated the Road Traffic Act (unlicensed driving) without obtaining a driver’s license, the Defendant driven Jone Starex, as described in paragraph 1(b), at a section of about 160 km from the front corner of the “Jaam Police Station” located in Seongbuk-gu Seoul, Seongbuk-ro 135, Seongbuk-gu, Seoul, for the same time and place as Paragraph 1(b).
