Punishment of the crime

[Power of Crime, which is the requirement for repeated crime] The Defendant was sentenced to six months of imprisonment with prison labor by the Incheon District Court on July 19, 2013, and completed the execution of the sentence at the Incheon Detention House on November 14, 2013.

【Criminal Facts】

[2014 Highest 1766] On August 7, 2014, the Defendant posted a false statement on the Defendant’s mobile phone in the vicinity of the operation Dong in Gyeyang-gu Incheon Gyeyang-gu, stating that “The Defendant would sell the galthot three mobile phones” by accessing the Defendant’s cell phone and reporting it to the victim C.

However, the defendant did not have a gallon three mobile phones, so even if he receives the price of goods from the victim, he did not have the intention or ability to send it.

Nevertheless, the Defendant received KRW 100,000 from C to the account in the name of the Defendant on the same day, and acquired KRW 12,450,000 from July 25, 2014 to July 25, 2014, total sum of KRW 33 times as shown in the attached crime list 1, such as the list of crimes.

【2014 Highest 1965】 On April 7, 2014, the Defendant posted a false letter stating that the fact in Gyeyang-gu Incheon Metropolitan Gyeyang-gu Operation Dong does not intend or have a capacity to sell the goods, and connect the “D” using his/her smartphones to sell the goods, and then send the proceeds to E who reported and contacted the fact.

The Defendant received KRW 500,000 from the victim to the account in the name of the Defendant on the same day, from around August 4, 2014, a total of KRW 82,00,000,000 from that time, as shown in attached Table 2, from August 2, 2014.
