A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime

However, the defendant did not have the intention or ability to send performance diskettes to the victim even if he/she receives the purchase price of performance diskettes from the victim.
Ultimately, the Defendant, by deceiving the victim as such, received KRW 100,000 from the victim to the I Bank account (J) in the name of the Defendant on the same day, and received KRW 100,000 from that time to November 14, 2018, by deceiving the victims on three occasions, such as the attached Table 2, until November 14, 2018, and acquired the money by transfer of KRW 235,00.
around August 9, 2018, the Defendant posted a letter stating that “The sales of Nakagwons will sell” after accessing the Internet CKafin at the Defendant’s house located in Daegu Seo-gu, Seo-gu, Seoul.
