“라는 내용이 기재된 플래카드를 들고 집회를 하자, 피고인을 비롯한 C 직원들은 플래카드가 출입구 일부를 막아 차량 출입에 방해가 되고 출입하는 차량에 의해 피해자가 다칠 우려가 있다는 이유로 피해자에게 출입구에서 떨어져서 집회를 할 것을 요구하였고 이에 피해자는 피고인측이 정당한 집회를 방해한다며 따지자 서로 시비가 되었다. 피고인은 위와 같이 피해자와 시비하던 중 피해자가 경찰을 부르고 피고인을 계속 촬영하자 화가 나 신고를 받고 출동한 경찰관들과 C 직원들이 듣는 가운데 피해자에게 “자슥들아, 조용히 해라, 시발놈들"이라고 욕을 하였다.
