1. The defendant A shall be punished by imprisonment with prison labor for ten months;

2. Defendant B shall be punished by a fine of KRW 1,000,000.

Punishment of the crime

1. Defendant A

A. A. On April 19, 2014, the Defendant violated the Road Traffic Act (unlicensed driving) and driven a F observer car without obtaining a driver’s license within a about 1km section from the front day of the E livestock shed located in D, Gyeongnam Development-gun to the front day of the 119 Safety Center.

B. The Defendant in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents is a person engaging in driving a motor vehicle that will do so.

On April 9, 2014, the Defendant, at around 19:00, proceeded bypassing a road of 119 safety center front of the G Motor Vehicle Driving School, which is located in the 58-lane per head of the G Motor Vehicle Development Center, from the 119 Safety Center.

On the other hand, there is a blind-distance intersection where traffic is not controlled, so there was a duty of care to check whether a person engaged in driving service is a vehicle or pedestrian by reducing the speed or temporarily stopping and to safely drive the vehicle.

Nevertheless, the Defendant neglected this and did not discover the victim H (70 years of age) who crosses the road from the right side to the left side while driving the vehicle without obtaining the driver's license as above, and was the front part of the Defendant's vehicle.

Ultimately, the Defendant suffered injury to the victim, such as the injury of her part with approximately 10 weeks of medical treatment, and her part of her retirement, due to the foregoing occupational negligence.

2. Defendant B’s Defendant A

In order to assist the defendant's wife A with knowledge that he is driving a motor vehicle without a driver's license at the time and place stated in the port, he provided the defendant's F observer, and aided and abetted the crime by being accompanied by the chief officer.
