A defendant shall be punished by imprisonment for one year.

However, the execution of imprisonment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. D’s offering of bribe to D was appointed as a public official of Grade 9 in Seoul Special Metropolitan City on June 23, 1990 and served as a public official of Grade 6 in Seoul Viewing F. From April 1, 2005 to March 11, 2012, while performing the duties of supervising the whole process of construction from various government-funded construction work to the design, construction, payment of money, and completion of construction. While it was possible to work as a public official of technical official of Seoul Special Metropolitan City during the dispatch service at the Board of Audit and Inspection from March 12, 2012 to March 11, 2015, it was possible to work as an ordering or construction department of government-funded construction work at the time of personnel transfer in the future.

From around 2009, the Defendant was the representative of K K, a corporation that mainly performs government-funded construction works such as the maintenance and repair of facilities in Yongsan-gu Seoul Yongsan-gu, Seoul, and was awarded a subcontract for L facilities flood control and emergency restoration works ordered by G in Seoul, and was performing construction works under the supervision of D.

On February 11, 2010, the Defendant was in charge of the supervision of the construction works run by Defendant companies at the Seoul Special Metropolitan City Group around February 11, 2010.

D received money in return for the provision of convenience in supervising the construction work from D, and remitted the amount of KRW 10 million to the account of the D's bank in its place.

From that time until August 13, 2014, the Defendant remitted total of KRW 40,50,000 to D over five times, such as the first list of crimes committed in attached Table 1.

Accordingly, the defendant accepted a bribe in relation to the public official's duties.

2. On June 18, 2001, M grants to M was newly employed on March 1, 201 as an employee of the Seoul Special Metropolitan City Facilities Management Corporation’s O (Grade VI) while serving as a contracting employee. From March 1, 2010 to March 31, 2013, M delegated the work of supervising the construction of “facilities construction from among the Q Facilities Maintenance Work” and “facilities construction work from among the Q Facilities Maintenance Work” ordered by G under Seoul Special Metropolitan City’s control while serving in P from March 1, 2010 to March 31, 2013.
