A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around January 21, 2010, the Defendant acquired the borrowed money by telephone to the victim C and made a false statement to the effect that “the money to be used in the business is urgently needed. The Defendant would be repaid once a week if he/she borrowed only KRW 19 million.”

However, in fact, the Defendant had been living together with the victim, “I would like to engage in money transactions with the victim because I would not return the money which he had been incurred in running business from the previous victim, and I would like to lend money from the victim. I would like to use the money as if I would use the money.” At the time, the Defendant had no intention or ability to pay the money within one week even if I would have borrowed money from the victim because I would like to bear approximately KRW 100 million obligation without any particular property.

Nevertheless, the Defendant, by deceiving the victim as such, received KRW 19 million from the victim to the Agricultural Cooperative Account in the name of E designated by the above defendant on a temporary basis.

2. On March 26, 2011, the Defendant acquired a promissory note, the Defendant used the FF’s agreement in a criminal case in which G filed a criminal complaint against the Defendant, and received a promissory note causing 1, par value 7,00,000 from the issuer Company H representative director I, par value 70,000, and issued the said note to D on behalf of the Defendant.

Accordingly, D transferred the above bill to the victim C as part of the existing obligation owed by the victim, and received 20 million won from the victim.

On September 26, 2011, the Defendant received a promissory note from HH representative director I, par value 70 million won, which is the victim at the K coffee shop located in Suwon-gu, Busan, Busan, from H, and will offer KRW 20 million among them until October 30, 201.
