The appeal is dismissed.
The costs of appeal are assessed against the Plaintiff.
Reasons
The grounds of appeal are examined.
Examining the record in light of the relevant legal principles, the lower court is justifiable to have determined that a proximate causal relationship between the deceased’s work and the deceased’s death cannot be acknowledged on the grounds as stated in its reasoning by partially citing the reasoning of the first instance judgment. In so doing, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds
Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
