A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

A. As above, the Defendant, upon receiving a decision to grant subsidies on August 31, 2017, by deceiving a public official in charge of the Korea Army Administration, was transferred KRW 10 million from September 12, 2017 to a new bank account (D) with the name of an agricultural company B.

As a result, the Defendant received the national subsidy from the victim in the Republic of Korea at the same time as he received KRW 10 million from the victim.

B. On August 30, 2017, the Defendant submitted a “G application” to the victim foundation F, a public institution, which provides funds to manufacturers, etc. of agro-fishery life in Geumcheon-gu, Seoul Special Metropolitan City, Seoul Special Self-Governing Province, to the effect that “the Defendant would use the funds for developing special DNAs and creating prototypes.”

However, in fact, the defendant has a large amount of obligation like the above paragraph (a) and has received subsidies from the victim, and there was no intention or ability to use the product for the development of the product.

Around September 25, 2017, the Defendant, by deceiving the victim, received KRW 6,440,00 from the victim to the Agricultural Cooperative (H) account in the name of the agricultural corporation B.

2. The Defendant shall be the 2018 Highest 262.
