Reasons
Punishment of the crime
Defendant A entered into a soil and sand reclamation contract at the construction site of E elementary school located in Ansan-si, Seoul-si on November 2016.
In order to obtain earth and sand to be used for the above soil and sand reclamation work, Defendant F operator G of the Victim F Co., Ltd. on November 2016 is at the site of reclamation of E elementary school soil and sand in Ansan-si.
By supplying Saturdays, it was discussed that the Plaintiff would pay the price calculated as KRW 55,00 per 17m2 per 17m2 on the face of a week by calculating the price.
However, since the defendant did not have any specific property at the time, it should be used as living expenses or other business funds even if he received the money for the construction cost from the owner of the above land, so even if he received the money from the owner of the above land, he did not have the intention or ability to pay the money as agreed upon.
The Defendant, as seen above, obtained the victim’s false statement from November 4, 2016 to January 6, 2017 from the victim, and acquired the land of KRW 21,880,00 in total at the construction site in the J, K industrial company in the J, and L’s adjacent site in the M cafeteria.
