Reasons
1. Basic facts
A. The Plaintiffs of land owners prior to the acquisition by agreement are those who owned each land as listed below.
(2) The Plaintiff 1’s land No. 1 in Dongdaemun-gu Seoul Metropolitan Government No. 72m2 and the Plaintiff 2 in this case’s land No. 2 in this case, the Plaintiff 2 in this case’s land No. 115m2 and the Plaintiff 2 in this case’s land owned by the Plaintiffs hereinafter referred to as “each land of this case”). Determination of urban planning facilities on the land No. 1 of this case and acquisition of land No. 1 of this case by the defendant of this case) The defendant head of the Gu publicly announced the urban planning project (road implementation plan as Dongdaemun-gu Seoul Metropolitan Government Public Notification I) approved with the following contents on March 26, 2001 to implement the project to create roads in the daily source of land G through H from Dongdaemun-gu Seoul Metropolitan Government.

D. Project operator: Defendant 2) The Defendant is the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects for the “project for the construction of the above road” (hereinafter “Land Compensation Act”).
Accordingly, on October 11, 2001, the Plaintiff acquired the land of this case from the Plaintiff A, and around that time paid KRW 70,884,000 to the Plaintiff as compensation for the said acquisition. (c) The Defendant, the head of the Gu, who determined the urban planning facility regarding each of the instant land, announced the implementation plan for the first park development project, which was approved on May 12, 2003, to implement the project to create a park on the land of 23 lots in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, including each of the instant land, (hereinafter referred to as “park 1” and “the project to develop the first park”).
Accordingly, the road creation project that was scheduled for the land of this case is expected to be implemented.
