1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The network E (hereinafter “the network”) acquired ownership on August 10, 1978 with respect to the land of Dongdaemun-gu Seoul Metropolitan Government Fro 321 square meters (hereinafter “instant land”).
B. On October 23, 2002, in order to implement a project to build public parking lots (hereinafter “instant parking lot project”) on a lot of 23 lots including the instant land (hereinafter “instant project site”), the Defendant head of the Gu publicly announced on October 23, 2002 the decision of urban planning facilities and approval of topographic drawings as G G in Dongdaemun-gu Seoul Metropolitan Government. On May 6, 2003, the instant parking lot project implementation plan approved as follows was publicly announced as H in Dongdaemun-gu Seoul Metropolitan Government.
Location of the project site: Dongdaemun-gu Seoul Metropolitan Government and 22 lots;
(b) Category of business: An urban planning facility project;
(c) Project name: Construction work for a public parking lot in the F-Japan;
(d) Scale of business: 1,464 square meters in size, 23 three-dimensional shapes, and 127 parking spaces;
(e) Name of the project implementer: The head of the defendant;
C. On July 29, 2003, the Defendant acquired the instant land from the Deceased on July 29, 2003 under the Act on Acquisition of and Compensation for Land, etc. for Public Works for the instant parking lot business (hereinafter “Land Compensation Act”). Around that time, the Defendant paid KRW 706,681,50 to the Deceased as compensation for the said acquisition.
From January 14, 2004, the Defendant installed a public parking lot in the form of building (hereinafter “instant parking lot”) in the instant project site from around January 14, 200, and operated the instant parking lot from October 15, 2004.
E. On May 29, 2008, the Mayor of Dongdaemun-gu Seoul Metropolitan Government: (a) designated the size of 55,523 square meters, including the instant land, as “J Housing Redevelopment Improvement Zone”; (b) determined the plan for the installation of urban planning facilities to abolish the instant parking lot; and (c) publicly announced it as KK in Seoul Metropolitan Government.
The head of the Gu shall on July 4, 2008.
