Punishment of the crime

1. Violation of the Act on the Punishment of Arrangement of Commercial Sex Acts;

A. On September 2014, the Defendant agreed to give money to E and to have sexual intercourse with E by accessing the Defendant’s house located in Busan High-gu, Busan High-gu, to the “W&C” (m.N.co.km) that was posted by E (19 years of age and leisure).

2. No person shall photograph another person's body against his/her will, using a camera or any other mechanical device equipped with similar functions, which may cause sexual humiliation or sense of shame;

Nevertheless, the Defendant set up one of his smartphones under the victim E before having sexual intercourse with the date and time set forth in Paragraph 1(b), at the place, immediately before having a sexual intercourse with the victim E, and sought a video photographer, and subsequently, the Defendant’s clothes made it impossible to see part of the above smartphones as the victim’s clothes, and made the face taken twice in total by having sexual intercourse with the victim as described in Paragraph 1(b).

Accordingly, the defendant taken a total of twice against his will using a camera to take the body of the victim.

3. The defendant, like the statement in paragraph (2), has the victim's body pictures, etc. using a visual recording of video images with the victim E, where the victim E has a sexual intercourse.
