1. The summary of the facts charged is the owner of A truck. B, who is the employee of the defendant, loaded the freight exceeding 11.6 metric tons at a Dong/Gun mountain station located in the 137.3 kilometer coast Highway on September 19, 2007 and operated the said vehicle in violation of the restriction on operation.

2. The Constitutional Court Decision 2008Hun-Ga17 dated July 30, 2009 rendered on the 2008Hun-Ga17 (former part of Article 325 of the Criminal Procedure Act) that each of the applicable provisions of this case loses its effect retroactively;
