A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. 피해자 F, G에 대한 범행 피고인은 C, D, E과 공모하여, 2012. 1월 중순경부터 다음 날 01:00경까지 전남 강진군 I에 있는 C의 동거녀 집 거실에서, 피해자 F, G와 함께 일명 ‘도리짓고땡’이라는 도박을 하면서, E은 미리 위 목화투를 D에게 건네준 후 거실에 있는 서랍장 안쪽에 목화투를 감지할 수 있는 적외선 카메라와 무선 송신기를 설치한 다음, 집 밖에 주차한 자신의 차 안에서 화투패의 높고 낮음을 판독할 수 있는 프로그램이 설치된 컴퓨터와 모니터를 통해 도박장소를 관찰하면서 도박에 참가한 D이 지닌 무선수신기에 도박에 승할 곳을 신호로 보내 주고, D은 E으로부터 건네받은 목화투를 사용하여 도박을 하면서 자신의 허리에 찬 무선 수신기를 통해 전달된 진동횟수를 감지하여 이를 함께 도박에 참가한 피고인과 C에게 피해자들이 알아채지 못하도록 손가락 개수로 그 숫자를 알려주고, 피고인과 C는 바닥에 놓인 화투패 4곳 중 D이 알려준 손가락 개수에 해당하는 곳에 도금을 거는 방법으로 피해자들로 하여금 정상적인 도박을 하는 것처럼 기망하여, 이에 속은 피해자들로부터 그 무렵 합계 약 650만 원 상당을 따 이를 편취하였다.
