Reasons
Punishment of the crime
From September 2013 to November 201 of the same year, the Defendant served as the CFS Co., Ltd. (hereinafter referred to as “FNS, Ilyang-gun, and Hanyang-gun, Inc.). From January 2014 to August 2014, the Defendant was working as an employee of the Korea-FFS Co., Ltd., Ltd., a company manufacturing and processing red powder within the YY-gun, Seocheon-gun, Seocheon-gun, Chungcheongnam-gun, and the Defendant was operating the “Agricultural Company E”, which mainly manufactures, processes, and distributes red powder powder in Jung-gu, Chungcheongnam-si, and the victim was operating the Defendant Company E.
The Defendant, while working as F at the same time in Hanyang Co., Ltd., 2014, had known of the victim on early 2014. As if he had the ability to arrange for the victim to deliver the molds to the victim, the Defendant thought that he had the ability to arrange for the use of the molds to the victim.
1. On May 27, 2014, the Defendant made a false statement to the effect that “Around May 27, 2014, the Defendant would allow the victim to supply the molds powder to the Hrenk Office located in Sinsan-si, Sinsan-si, an agricultural company E to supply it to the Yanyang FFE, with cash 300,000 won, in terms of the rental cost and expenses of a siren, and the collection of molds powder.”
However, in fact, the defendant has worked for about two months in Tyang FS and did not have an intention or ability to arrange for the supply of red molds to the above company.
The Defendant received 300,000 won in cash, and 16,200 won in the market value, from the victim, the Defendant received 1.8 km of molds.
From around that time to August 20, 2014, the Defendant, as indicated in the list of crimes in the attached Table, by deceiving the victim by the same method ten times in total, from the Gunsan and the Eup area, and received a red powder of KRW 4740,00 in total and KRW 736,200 in the market price.
Accordingly, the defendant was given property by deceiving the victim.
