A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
[2019 Highest 3986] The Defendant purchased agricultural and livestock products, etc. on credit without equity capital, and raised profits from such sales to the customer immediately after purchasing them on credit. If he/she fails to receive the transaction amount from the customer, he/she has a structural defect not to pay the credit amount to the purchaser, and in fact he/she has been accused of criminal complaint several times due to failure to pay the credit amount to the purchaser.
On the other hand, from October 2017 to November 201 of the same year, the Defendant: (a) purchased a large number of 24.99 million won on credit from CCo., Ltd.; and (b) purchased a large amount of 24.99 million won on credit from CCo., Ltd.; (c) sold to D; (d) however, C Co., Ltd., which was the purchaser due to the Plaintiff’s failure to pay the credit amount; and (e) there was no other special property, and (e) there was no ability to pay the credit amount to the victim, even if the Defendant purchased a red powder from E Co., Ltd. to sell it to D by means of the above method
Nevertheless, on January 2, 2018, the Defendant, at G agency located in Kimpo-si, Kimpo-si, Kimpo-si, stated the name “B General Management Director A” as the victim’s representative director at H, and the Defendant, at the same time, paid the price of the molds by the 15th day of the following month when he/she supplied the molds powder to domestic company B, on credit. Since there is a house with a building in Korea, the price of the goods is not known, and there is a house within our company.” The Defendant, at the same time, supplied the victim with the warehouse of the above G agency designated by the Defendant at around the 3th of the same month, KRW 10,00 per annum of the market price of KRW 6.35,00 per annum of the same month, around the 12th of the same month, and at the same time, KRW 2,500,00 per annum of the market price of KRW 670,000 per month.
