A. While the victim of misunderstanding of facts was unable to repay the borrowed money, the defendant was found in the new wall and again requested money, and the defendant did not pay money to the victim's hand while benefiting from this.

B. The lower court’s sentence of unreasonable sentencing is too unreasonable.

2. Determination

A. Comprehensively taking account of the evidence duly admitted and examined by the court below, since the defendant could recognize the fact that the defendant had committed the victim as stated in the judgment below, the defendant's statement of mistake of facts is without merit.

B. In full view of the records of this case’s unreasonable sentencing and all the sentencing conditions indicated in the argument, the Defendant’s assertion of unfair sentencing is without merit, as the lower court’s punishment is too unreasonable.

3. Therefore, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act, since the defendant's appeal is without merit. It is so decided as per Disposition.
