Defendant shall be punished by imprisonment without prison labor for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person engaging in driving a rocketing car.

On May 16, 2017, the Defendant driven the above vehicle around 19:23, and driven the three-lane road in the front direction of Seongbuk-gu Seoul, Seongbuk-do, Seoul, along the three-lane from the direction of the tin basin, the Got Jeju Island driven along the dynamic direction.

On the other hand, since there is a crosswalk where signal lights are installed at the front door, it was confirmed whether a person engaged in driving of a motor vehicle is a person to reduce the speed and to see well the front door, and there was a duty of care to safely drive the motor vehicle in accordance with the traffic signals to prevent the accident in advance.

Nevertheless, the Defendant neglected this and proceeded without viewing the fact that the signal is changed to the stop signal of the vehicle, and due to negligence, the Defendant got off the victim E (the 16-year old age) who was a pedestrian with the crosswalk in accordance with the pedestrian signals from the right side of the defendant's running direction to the left side of the road.

Ultimately, the Defendant suffered injury to the victim, such as blood transfusion, mathma, and pelvisa, which require approximately eight weeks of medical treatment due to such occupational negligence.

The following circumstances are considered: (a) the occurrence of the instant accident by gross negligence that the Defendant entered the intersection in contravention of the signal and caused the instant accident; (b) the victim suffered serious injury due to the instant accident; and (c) the fact that the agreement with the victim was not reached; (d) the Defendant recognized the facts of the instant crime; (b) the Defendant is against the mistake; (c) the vehicles operated by the Defendant are covered by a comprehensive insurance; and (d) the Defendant is aged.
