Reasons
Punishment of the crime
[Attachment] Defendant A is the head of the hospital of the “K Hospital” located in Gyeonggi-si J, and Defendant B is the head of the nursing division of the said hospital from January 201 to October 2010; Defendant C is the head of the nursing division of the said hospital from March 28, 2011 to February 28, 2014; Defendant D is a person who worked as the nurse of the said hospital from May 1, 2013 to February 28, 2014; Defendant D is a person who worked as a nurse of the said hospital from May 28, 2013 to February 28, 2014; Defendant D is not a pharmacist or herb pharmacist, but he is not a doctor, but he is allowed to prepare drugs directly.
1. Defendant A instructed C, D, and B, a nurse who does not obtain a pharmacist's license from January 1, 2010 to February 28, 2014, to prepare medicines to inpatients, D, and B during their work period (excluding month and day) to prepare medicines in accordance with the above instruction, although Defendant A, a doctor, and the doctor, was to directly prepare the medicines.
(2) In addition, Defendant B, without obtaining a pharmacist’s license from January 2010 to October 2010, he/she independently prepared medicines to hospitalized patients in a dispensary without undergoing specific and direct management and supervision as to the preparation of medicines from A, a doctor at the above hospital (excluding day and day) without obtaining a pharmacist’s license.
3. Although Defendant C’s pharmacists and herb pharmacists are not allowed to prepare medicines, Defendant C independently prepared medicines to inpatients in a dispensary without having obtained a pharmacist’s license from March 201 to February 28, 2014 (excluding day-to day-day and day-day) without having received specific and direct control and supervision of the preparation of medicines from A, who is a doctor at the above hospital (excluding day-to-day and day-day).
