1. The defendant shall be the plaintiff.
A. Of the land size of 7,692 square meters in Dong-gu, Dong-do, the attached appraisal marks 24, 25, 26, 27, and 24 shall apply.
Reasons
1. Facts of recognition;
A. On June 24, 1999, the Plaintiff completed the registration of ownership transfer in his/her name on the one-half portion of C forest land 7,692 square meters (hereinafter “instant land”). On June 11, 1999, the Defendant completed the registration of ownership transfer in his/her name on May 30, 2014 with respect to one-half portion of the instant land as to May 29, 2014.
B. On May 30, 2014, the Defendant completed the registration of ownership transfer in his/her name on the ground of the gift made by May 29, 2014, with respect to one half of the size of D Religious Site 2,226 square meters adjacent to the instant land.
C. The registration of ownership transfer was completed on September 19, 2002 with respect to the second floor cultural and assembly facilities (hereinafter “instant building”) constructed on the land adjacent to the instant land, E, Dongbcheon-si, E, D, concrete slope 1, and concrete slope 1, and the second floor cultural and assembly facilities (hereinafter “instant building”). The registration of ownership transfer was completed on the ground of the gift made on January 3, 2003 as of January 3, 2003.
From April 7, 2003, the defendant continued to operate a charnel house in the building of this case from around April 7, 2003 to the present date.
E. Of the instant land, the Defendant indicated the attached Table 13, 41, 42, 43, 40, 39, 38, 37, 36, 33, 32, 31, 30, 29, 28, 27, 24, 17, 16, 15, 14, and 13 of the attached Table No. 13, 41, 42, 43, 40, 38, 36, 33, 33, 30, 29, 28, 27, the attached Table No. 24, 25, 26, 27, and 24 of the appraisal of the instant land (hereinafter “the attached Table No. 13, 24, 200, 23, 200, 23, 200, 16, 17, 18, 12, and 24.
In addition, the defendant connects the parts of the land of this case and the parts of the attached appraisal among the land of this case, each point of which is indicated in the attached Table 6, 45, 44, 43, 42, 41, 5, and 6.
