A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

In the name of 2020 large-scale 460, an unqualified person operates a telephone financial fraud organization that obtains money from victims by misrepresenting to many unspecified victims by calling a call center to a large number of unspecified victims.

Around April 13, 2020, the Defendant received a proposal from a person who was not aware of the name of the aforementioned telephone financial fraud organization, “to provide a daily allowance of KRW 100,000 to KRW 20,000,000,000,000,000,000,000 won or more, from another person's name and resident registration number, using another person's name and resident registration number at the nearest bank that received cash via B site.” After consenting to this, the Defendant received cash from the place where the said organization instructs, and then transferred it to the account directed by the said organization, and then received the consideration.

1. On April 20, 2020, the victim C’s name defective statement to the effect that “A person in charge of loan is an agent in charge of D Bank E. It will make loans at a low interest rate if the victim did not have an intent or ability to make a loan because he/she was not an employee in charge of D Bank loan,” and that “A person in charge of loaning KRW 12 million will make a loan to the victim. It would send an employee to the employee in cash.”

At around 10:00 on April 24, 2020, the Defendant: (a) on the third floor of the G parking lot G-gu G-gu G-gu G-gu G-type F in G-si, G-si; (b) received KRW 12 million from the victim in the name of the repayment of the loan; and (c) delivered the said money to the account designated by the winners of the name without passbook.

2. On April 24, 2020, the victim H statements will make a telephone call to the victim while the victim did not have the intent or ability to make the loan because the victim was not an employee in charge of the I bank. The victim H statements will make a loan of KRW 50 million at the interest rate of 3.9%.

In order to obtain a loan, the existing J Card loan amounting to KRW 12.6 million shall be paid in cash.
