A A shall be punished by a fine of KRW 3 million, and Defendant B shall be punished by a fine of KRW 1.5 million.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
[Criminal Justice] On September 28, 2016, Defendant A was sentenced to five years of suspended sentence to imprisonment with labor for a violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (special quasi-rape) at the Incheon District Court around September 28, 2016, and such judgment became final and conclusive around May 31, 2017. Defendant B was sentenced to ten months of imprisonment with labor at the Suwon District Court around June 15, 2018 and the said judgment became final and conclusive around August 17, 2018.
【Criminal Facts】
1. In using and managing a means of access by Defendant A, no one may lend the means of access by accepting, demanding or promising any compensation, unless otherwise specifically provided for in any other Act;
On May 2016, the Defendant lent the passbook in the name of the Defendant to Kwikset Service Articles (Account Number: D) of the C Union account under the name of the Defendant at the exit No. 14 of Bupyeong-gu Incheon, Bupyeong-gu, Incheon, and then notified the password by telephone.
As a result, the Defendant promised to receive a future loan in return for an intangible expected profit, and lent the means of access to a person who has no name.
2. On June 23, 2016, the Defendants posted a letter to the effect that “the gallonian 532 mobile phones are sold” by accessing Emallon city in Gangwon-gu, and send a cell phone to the victim G who made contact with the Defendants by reporting that “the gallon 532 mobile phones are sold.”
The purpose was to make a false statement to the effect that "...."
However, the Defendants did not have the above mobile phone and did not intend to sell or have ability to sell the above mobile phone even if they received the above transfer of the price as above.
The Defendants conspired to deception the victim as above and acquired 350,000 won from the victim’s account in the name of the Defendant A to the C Association on the same day.
