A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Forgery of private documents;

A. On October 2012, the Defendant made a file that contains the contents of “A” and “H” on a computer at an infinite location, and carried out H’s seal prepared in advance to the name of H by printing it out on a finite-gun, Hongsung-gun, F, and G, in which the Defendant’s wife paid the auction price to the court. A half of the Defendant and H make an investment into the Republic of Korea, one half of the profits is divided, and the H takes responsibility and receives a loan. On November 5, 2011, the Defendant made a file that contains the content of “A” and then printed it into a finter and carried out a H seal prepared in advance to the name of H.

Accordingly, for the purpose of uttering, the Defendant forged one copy of the real estate business agreement in the name of H, a private document on rights and obligations.

B. On October 2012, the Defendant stated in the column for the location of the “monthly rent contract” site at the location of the “monthly rent contract”, “Seoul Hong-gun J third floor,” “Seoul Hong-gun J. J in the monthly rent deposit column”, “S.S. on November 6, 2009,” “I’s name, address and resident registration number in the column of the lessor, and the name, address and resident registration number of the Defendant in the column of the lessee, and marked I’s official seal prepared in advance following I’s name.

Accordingly, for the purpose of uttering, the Defendant forged a monthly rent contract in the name of I, a private document on rights and obligations.

2. On October 10, 2012, the Defendant: (a) delivered each of the forged “Real Estate Partnership Business Agreement” and each of the “Monthly Contract” and each of the “Monthly Contract” to L to submit a lawsuit for construction cost claim against H and the Defendant at the office of the Defendant located in Bupyeong-gu, Seocheon-gu, Jungcheon-gu, Seoul, to the Seoul Central District Court 2012Kadan207546, which he filed against H and the Defendant, as described in paragraph (1).
