A defendant shall be punished by imprisonment for six months.

Punishment of the crime

1. Fraud;

A. From February 25, 2010 to August 2010, the Defendant deceptioned that “D” 103 operated by the injured party C residing in Gangseo-gun Hongcheon-gun, Hongcheon-gun (hereinafter “D”) from around May 31, 2010, the Defendant received KRW 480,000,000 in total from the victim’s account under the name of the Defendant by 111 times until August 23, 2010.”

However, the Defendant did not own a claim for security deposit or a loan out of the company at the time, while there was no certain income at the time, on the other hand, was liable for a debt exceeding 40,000,000 won, so even if he borrowed money from the victim, he did not have the ability or intent to repay

Accordingly, the defendant was given property by deceiving the victim.

B. From early September 2010 to February 201, the Defendant: (a) leased the Victim F’s House with Hearing impairment 5 in Incheon Strengthening Group E, and was residing together with the victim; (b) even if the Defendant borrowed money from the victim as referred to in paragraph (a), he/she did not have any capacity or intent to complete the payment thereof; (c) on September 20, 2010, the Defendant deceptions the victim, “I would have to complete payment within one month by setting up the house located in Seoul with a deposit or monthly income, if I would have borrowed the money from the victim; and (d) from the Korean Agricultural Cooperative located in the same upper bank, the Defendant received KRW 4,500,000 from the victim and received KRW 6,790,000 over six times in total from January 2011, as shown in the attached list of crimes (2).

Accordingly, the defendant was given property by deceiving the victim.

2. Forgery of private documents and the display of private documents;

A. The Defendant who forged private documents was requested several times from G slope belonging to the Mapo Police Station in Seoul, Mapo Police Station on suspicion of paragraph 1.
