Defendant shall be punished by a fine of KRW 5,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

The defendant was the male-child of the victim B.

1. On or after December 2009, the Defendant made a false statement to the victim B, stating, “The Defendant would lend KRW 7 million to the victim B for business.”

However, the defendant did not have any ability or intent to pay the money.

The Defendant, as such, by deceiving the victim, received KRW 7 million from the victim before the victim’s house.

2. The Defendant made a telephone call to the victim on the date in the same month as Paragraph 1, and made a false statement to the effect that “The Defendant would lend KRW 2 million to the victim, which would promptly be fair.”

On December 28, 2009, the Defendant received KRW 2 million from the victim before the victim’s house.

3. On March 2010, the Defendant made a false statement to the Defendant that “The Defendant did not have any money since there is no money so that he/she would have paid the money. It borrowed KRW 1,00,000 won.”

The same month

4. The Defendant received KRW 7 million from the victim before the victim’s house.

4. From March 2010 to March 2011, the Defendant made a false statement that “No money exists, must go to Apahn Hospital,” and that he/she borrowed money.”

The Defendant, as such, by deceiving the victim, received 4 million won from the victim.

5. On March 20, 2011, the Defendant: “Before the Victim’s House, the Defendant may sell the House with a set of KRW 4 million, which entered his/her own house. He/she sold his/her house and sold his/her house. He/she would have repaid his/her money. He/she borrowed KRW 4 million.”

The Defendant, as such, was given a delivery of 4 million won by deceiving the victim.

As above, the Defendant, even if he borrowed money from the victim, did not have the intent or ability to complete payment, deceiving the victim to total of KRW 24 million.
