1. The instant lawsuit shall be dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The purpose of the plaintiff is to set up the descendants of the clan as members of the clan with the aim of pursuing the prosperity and development of the clan, promoting the mutual aid among its members, and preserving and managing the clan property.

B. On September 9, 1946, the E-Bag F completed the registration of ownership transfer on each trade basis with respect to the land of 96 Busan Yangsan-gun G (hereinafter “Seoul-gun G land before the instant division”), H 149 square meters (hereinafter “H land before the instant division”), I 482 square meters, and J 503 square meters.

C. The deceased on Oct. 10, 1981 and died on Aug. 25, 1991 by the deceased on Aug. 26, 191, the deceased on Aug. 26, 1992, the deceased on Jun. 26, 1992 and the deceased on Jun. 26, 192 (in case of the common name of the above two parcels of land, the “each land before the instant partition” refers to the “each land before the instant partition”) with respect to the deceased F’s co-inheritors except the deceased K by reason of inheritance (including Defendant D, among them, the south of the deceased F’s spouse), each share transfer registration was completed in the name of Defendant B, the deceased’s spouse, including Defendant B and the deceased C, the president of the deceased K, under the name of the Defendants on the grounds that the remaining shares except the shares in the Defendants’ name have been completed immediately after that date.

Before the instant partition, G land was divided into the area conversion into the area of 317 square meters on June 26, 1992, and the administrative district change to the captain-gun on March 1, 1995, on August 14, 2009, the G land was divided into the area of 242 square meters in Busan-gun G-gun, Busan-gun (the real estate indicated in paragraph (1) of the attached Table) and the area of 75 square meters in L.

E. Before the instant partition, H land was divided into the area converted into the area of 493 square meters on June 26, 1992 and the administrative district change to the plane-gun on March 1, 1995, on August 14, 2009. The said H field was again divided into 371 square meters in Busan-gun, Busan-gun and Ma 122 square meters in size. The said H field was again divided into 371 square meters in H field and 361 square meters in size on July 11, 2014 (the real estate indicated in paragraph (2) of the attached Table) and 10 square meters in N field. The said M field was again divided into 122 square meters in size on July 11, 2014.
