The defendant's appeal is dismissed.

1. Summary of grounds for appeal;

A. The victim of mistake of facts did not have any injury to the extent that relief measures are necessary due to the instant accident.

B. In light of the legal principles, the victim left the scene first and there was no room for the defendant to take relief measures, and there was no need to take relief measures because the degree of the victim's injury was insignificant. Thus, even if the defendant notified the victim of false personal information, such notification does not constitute "domination" under Article 5-3 (1) of the Act on the Aggravated Punishment, etc. of Specific Crimes.

2. Determination

A. 1) According to the evidence duly admitted and examined by the lower court and the first instance court, the following circumstances are acknowledged. (A) The victim was faced with the head of the road while he was faced with the string part of the left bridge by the taxi on which the Defendant was on riding a bicycle at the time of the instant accident, by going beyond the bicycle.

B) The victim did not explicitly indicate that he is fine to the Defendant immediately after the occurrence of the accident, and rather, it appears to have explicitly expressed that his health condition is “not fine” due to the instant accident by having the driving school paid the driving school expenses to the driving school, and having the Defendant contact with the hospital. C) The victim, after completing the driving practice at the driver’s license test area, began at the home after the driver’s license test was finished, and the symptoms have deteriorated in the following day, the victim became aware of the fact that the Defendant called “the telephone phone number does not exist,” which was the contact number written by the Defendant to receive medical treatment at the hospital, and reported to the police. The victim actually received medical treatment at the hospital following the instant accident.
