피고인은 2015. 10. 24.부터 2016. 3. 22.까지 사이에 파주시 B 상가 앞 인도 상 약 2평(6.6㎡) 면적 천막(포장마차 유사) 안에 조리대 1개, 가스시설(조리가열용) 3개, 의자 2개 등 갖추고 그곳에 찾아온 손님에게 1일 평균 약 5만 원 상당의 떡볶이, 순대, 오뎅 등을 조리 판매하여 신고하지 않고 일반음식점 영업을 하였다.
