Reasons
1. Basic facts
A. The network D purchased, respectively, the real estate listed in paragraph (1) of the attached Table No. 1 of the state unregistered from E (hereinafter referred to as “instant land” according to the sequence of real estate listed in the attached Table No. 1 of the attached Table No. 1 (hereinafter referred to as “each of the instant land”) from E, and each of the instant land 1,230 square meters in Jincheon-gun, Jincheon-gun, Jincheon-gun prior to the subdivision of an unregistered state from F (hereinafter referred to as “G land before subdivision”), and died on December 4, 1979 without completing the registration of ownership transfer.
Due to the death of the network D, H(C) and the Plaintiff(C) succeeded to each of the 6/27 shares, net I(C), J(3K), Defendant B(C)’s shares, 4/27 shares, L(ma), M(ma), and N(N) shares, 1/27 shares, respectively.
B. On July 19, 1980 and October 17, 1980, Defendant B completed each of the above land in accordance with the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 3094, Dec. 31, 1977; hereinafter referred to as the “Special Measures Act”) with respect to each of the above land as the registration office of Cheongju District Court No. 8185, and with respect to each of the above land as the registration office of Cheongcheon District Court No. 11215, Dec. 30, 197 (hereinafter referred to as “each of the above registration for preservation”).
C. On October 31, 2002, Defendant B divided G land before subdivision into the land of this case 2, 3, and completed the registration of ownership transfer with the Jincheon District Court No. 13917 as to the land of this case to Cheongju District Court No. 13917.
The deceased I died in around 2012, and the defendant C, the deceased I's heir, completed the registration of ownership transfer on January 28, 2013 as the receipt of the same registry office on the above land by agreement and division No. 1432.
Each of the above registrations of ownership transfer, which is completed in sequence under the name of the network I and the defendant C.
