A defendant shall be punished by imprisonment for not less than one year and six months.
Reasons
Punishment of the crime
The defendant was aware of the victim B and the university's postship for a long time.
1. On January 7, 2009, the Defendant made a false statement to the victim stating that “The Defendant has a sentence to engage in a business exporting Doglass Doglass Doglass Doglass Doglass Doglass Doglass Dogs from a foreign country, which is well in the present business.”
However, in fact, the Defendant did not have any particular property at the time, and was thought to gambling in the casino with the money received from the victim, so there was no intention or ability to repay the said money even if he borrowed money from the victim.
As above, the Defendant, including by deceiving the victim as above, received 29,200,000 won from the victim to the deposit account in the name of the Defendant on the same day as the money borrowed from the victim. From around that time to April 16, 2009, the Defendant acquired a total of 440,301,50 won through 27 times as shown in the attached crime sight table 1.
2. On June 1, 2010, the Defendant made a false statement stating that “The Defendant would pay the full amount of the obligation to the victim at a place that is not known to him/her on or around June 1, 201, 4% of the interest per month if he/she loans money.”
However, in fact, the Defendant did not have any intent or ability to pay the interest and principal that the Defendant promised to pay to the victim within the due date because the Defendant used for gambling with the money borrowed from the victim, or was thought to lend money to the victims of his name butt money.
As above, the Defendant, including deceiving the victim as above and receiving 3,00,000,000 won from the victim’s deposit account in the name of the Defendant on the same day from that day to April 30, 201, by deceiving the victim as shown in the attached Table 2 of the Crimes List 17 times, and by deceiving the victim as well as 116,690,30 won.
3. The Defendant is in a place where it is unknown on November 23, 201.
