Reasons
Punishment of the crime
On May 2017, the Defendant listened to the horses that it is possible to borrow a loan under favorable conditions when he/she purchases insurance products from the employees in charge of B while operating a music research institute in the Suwon-si District, and around that time, he/she tried to obtain the mutual-aid money by creating false records and other records as if he/she had received dental treatment, mother D (date of accession: May 22, 2017), large-scale E (date of accession: May 23, 2017) and small-scale E (date of subscription: May 23, 2017) from four family members, such as C, etc. with the consent of four family members, including C, etc., to subscribe to “G” related to the compensation for dental treatment in their respective names.
1. On November 28, 2017, the Defendant violated the Special Act on the Prevention of Fraud by Insurance: (a) on the part of the Defendant’s mother: (b) on September 22, 2017, despite the fact that he/she had received dental treatment at H hospital from September 22, 2017 to October 17, 2017; (c) on the Internet as if he/she had received dental treatment in a normal manner; (d) on the part of the Defendant’s mother, sent out the name and date of sampling of the H hospital as if he/she had received dental treatment in a normal manner; and (d) deleted the name and date of sampling from the Internet as corrected tape; and (e) made a claim for mutual aid for the accident on the part of the victim B
As above, the Defendant: (a) by deceiving the victim; (b) obtained the payment of KRW 913,50 from the victim on December 1, 2017; and (c) obtained the payment of KRW 913,500 from the victim; and (b) from May 16, 2019 to May 16, 2019, the Defendant sought a false mutual-aid amount under the name of the said family members on a total of 20 occasions, such as the list of crimes, and attempted to obtain a total of KRW 9,845,00 from the victim (18 payments) and obtain a total of KRW 9,86,500 from the victim; but (c) did not receive the mutual-aid money, and
2. The Defendant, as indicated in paragraph (1) around November 28, 2017, claiming a false mutual-aid amount under the Defendant’s mother’s name, the H hospital doctor I via the Internet.
