Reasons

Punishment of the crime

1. On April 6, 2013, the Defendant made a false statement that “flass test is sold” on the Internet website, and that flass test is sent to the victim B who reported and contacted the Defendant’s writing on his/her own. On deposit of money, the Defendant sent KRW 50,000 to the Agricultural Cooperative (C) account in the name of the Defendant, which the Defendant believed to be true.

However, even if the victim remitted money, the Defendant did not have the intent or ability to sell the lass test.

As above, the Defendant was delivered by deceiving the victim and receiving remittance equivalent to the same amount.

2. On April 11, 2013, the Defendant made a false statement that “Am-3 is sold” in a smartphone display room, an Internet site, and that if the Defendant paid money to the victim D who reported and contacted the Defendant’s writing, the Defendant would send Am-3 to the Defendant’s account. The victim who believed it as true remitted KRW 150,000 to the Agricultural Cooperative (C) account in the name of the Defendant.

However, even if the victim remitted money, the Defendant did not have the intent or ability to sell the lass test.

The defendant, as above, is accused of remitting a considerable amount of money by deceiving the victim.
