A defendant shall be punished by imprisonment for a term of one year and two months.
Seized evidence 1, 7, 8 or 9 shall be forfeited from the accused.
Reasons
Punishment of the crime
1. Fraud and attempted fraud were received from a lender, whose name cannot be known together with C, and used to receive and keep another person’s resident registration certificate, driver’s license, duplicate copy of resident registration certificate, etc. to receive cellular phone in another person’s name and to have such benefit divided.
On July 3, 2012, the Defendant: (a) by reporting the sales broadcast of the mobile phone in Yeonsu-gu, Yeonsu-gu, Incheon, where the Defendant resided, and deceiving the Defendant by using the “AF, a resident registration number of AE, and making orders to purchase the mobile phone via ARS; and (b) by deceiving the Defendant as if AE, he/she were AE, he/she was handed over two mobile phone calls around July 11, 2012.
In addition, the Defendant conspired with C during the period from July 3, 2012 to December 17, 2012, in collusion with CG during the period from January 2013 to March 2013, 2013, and on March 2013, the Defendant: (a) conspired with BG in collusion with the Defendant; and (b) on March 2013, 2013, Haman, by deceiving each victims over 15 times in total, as indicated in the List of Crimes (1) by means of the foregoing method; and (c) received or attempted KRW 25 cellular phone period of KRW 17,143,401.

On March 7, 2013, at around 18:11, the Defendant established a mobile phone (AI) under the name of AH, which was issued as shown in No. 11 of the List of Crimes No. 11, by accessing the Internet game (www.hangme.com) by using a computer located in the cyber host room near the Yeonsu-gu Incheon Yeonsu-gu Incheon Metropolitan CityJ, to enter the account under the name of AH, and when entering the settlement amount, the Defendant entered the settlement amount into the mobile phone (AI) under the name of AH as shown in No. 11 of the List of Crimes No. 11, the victim, the settlement agency (the facts indicate AH that was stolen by the above name as the victim, but both the defrauded and the dispositive person should be deemed the settlement agency, and the victim who suffered property loss shall also be deemed the said settlement agency).
