Defendant shall be punished by imprisonment for a term of one year and six months.

Punishment of the crime

On July 23, 2013, the Defendant sentenced the Gwangju District Court to one year of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Egressing Vehicles) and completed the execution of the sentence on March 31, 2014.

On May 11, 2016, at around 01:04, the Defendant opened an air-conditioner room in the front of the D restaurant located in Gwangju-gu, Gwangju-gu, with two descendants, and stolen the cargo vehicle that he/she operates.

1. On June 11, 2016, the Defendant was under the influence of alcohol level of 0.261% among blood transfusions around 15:05, the Defendant driven a f freight vehicle at the 4km section of approximately four kilometers from the vicinity of the “J” restaurant located in the Dong-gu Seoul Special Metropolitan City, to the “H” located in the same Gu.

2. On the date and time indicated in paragraph 1, the Defendant, while driving the said truck under the influence of alcohol as set forth in paragraph 1 in the vicinity of the above H operated by the victim I (40 years), was able to get a water tank and a tent pole installed in the front of the said H while driving the said truck. The victim from the outside of the said place told the victim to stop and drop his/her motor vehicle, with the intention of disregarding the defect of the knife and driving the said motor vehicle.

The Defendant driven the said truck under the influence of alcohol level of 0.261% in blood at the date and time, at the place, as described in paragraph (1), and moved back from the direction of the above H to the direction of the school patrol box in the direction of the above H, and led the Defendant to drive the said truck at an insular speed.

At the time, the injured person said that the Defendant would stop and drop the motor vehicle in the vicinity of the above truck, and it is a road in the vicinity of the victim's commercial building, and in such a case, the driver of the motor vehicle thoroughly sees the right and the right of the front side to the person engaged in the driver's duty.
